Review Committee
The Review Committee is a tribunal that reviews legal aid decisions.
The Committee reviews
- decisions made by a director general refusing or withdrawing legal aid;
- requests for repayment of legal aid costs or decisions regarding contributions payable (Section 74, An Act respecting legal aid and the provision of certain other legal services);
- decisions by a director general granting or refusing a contestation by an interested party regarding the financial eligibility of a legal aid recipient (Section 75, An Act respecting legal aid and the provision of certain other legal services).

Application for review
Filing an application for review
If you disagree with the decision of the General Manager following an application for legal aid, you may appeal the decision to the Review Committee by completing our revision form attached to your notice of refusal or withdrawal of legal aid
Deadline for filing an application for review
Your request for review must be submitted within the deadline set by law. This time limit is 30 days after receipt of the notice of refusal or withdrawal of legal aid.
How to file a request for review ?
Complete the revision request form and make sure it is signed. Request for review form

You can also submit your request for review in a letter. Attach a copy of the notice of refusal or withdrawal of legal aid to your application for review and forward it to the Review Committee.

Telephonic hearing
You will receive a Notice of Hearing attending you to a hearing. Your attendance at the telephone hearing is not mandatory. It is very important to ensure that the review panel’s decision-makers have all the relevant evidence on the record and that they know your arguments.
On the day set for the hearing, if you do not show up or if the Review Committee can not reach you by telephone, decision-makers will hold the hearing outside your presence, if necessary. However, you may submit your evidence or arguments to the Review Panel in writing prior to the hearing date. Decision-makers will then make their decision based on the evidence on the record.
Be aware that the Review Committee may also, after reviewing the file, render a decision without a telephone hearing if it deems it appropriate and the decision is in your favor. This is called a decision on file.
Filing documents
At any time prior to the hearing, if you wish to file other documents, fax or mail them to the Review Committee as soon as possible. It will be important to mention the number of your file under review in all correspondence concerning your request for review.

Is it possible to change the date of the hearing?
To request a hearing, you must have a serious reason. If so, send your rebate application as soon as possible. You should be aware, however, that the date and time already set for the hearing are maintained until the Review Committee has notified you that it accepts your request for surrender.
How to request a hearing postponement
To request a postponement of a telephone hearing, you must have a serious reason. If this is the case, first contact the Review Committee, which will suggest alternative dates for the telephone hearing.
Please note, however, that the date and time already set for the hearing will be maintained until the Review Committee has notified you that it accepts your request for remission. The same applies if your application is refused.
- The application for remission made more than 7 days before the date of the hearing.
If it is a first request for a rebate, the Review Panel will set a new date for the hearing.
- The application for remission made less than 7 days before the hearing date.
Decision-makers examine the application for remission and dispose of it, taking into account, in particular, the nature of the file, the diligence of the applicant and the seriousness of the grounds invoked. If the decision-makers grant the remission, they will fix the new date of the telephone hearing while notifying the applicant.
Discontinuance
Until the decision is taken, you can withdraw your request for review. This is discontinuance.
A discontinuance is an important legal act and its consequences are final. Make sure you have all the necessary information before you withdraw, as it will not be possible to change your mind afterwards.
To withdraw your request for review, provide the Review Committee with a clear statement of your decision to withdraw. This notice must be signed by you or your representative.

Final decision and without appeal
Decision-makers make the decision within 10 days of the end of the hearing, depending on the nature of the request for review. In some complex cases, the delay may be longer.
The written decision, including the reasons and signed by the decision-makers, is sent to the applicant and to the legal aid office that issued the notice of refusal or withdrawal of legal aid. This decision is final and without appeal. Any person affected by it must comply with it.
